By creating an account or using Apex AI (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Apex AI is a software platform that helps you generate marketing and business content using third-party artificial-intelligence models. The Service provides templates, an editor, and tools to organize and manage the content you create.

You must provide accurate information when registering and are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Apex AI lets you connect your own API keys from third-party AI providers (such as OpenAI, Groq, Anthropic, Google, and others). You are solely responsible for those keys, for any usage and charges they incur with the respective provider, and for complying with each provider’s own terms of service and usage policies. We make requests to those providers on your behalf using the keys you supply; we do not control their availability, pricing, or output.

You agree not to use the Service to:

• Generate content that is unlawful, infringing, defamatory, or harmful;
• Violate the terms or usage policies of any connected AI provider;
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
• Generate spam, malware, or content intended to deceive or defraud.

You retain ownership of the prompts you submit and the content you generate, subject to the terms of the AI provider that produced it. You are responsible for reviewing generated content before relying on or publishing it. AI output can be inaccurate; you use it at your own risk.

Paid plans are billed on a recurring basis through our payment processor. By subscribing, you authorize us to charge your payment method for the applicable fees until you cancel. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will be accurate, complete, or fit for any particular purpose.

To the maximum extent permitted by law, Apex AI and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these terms or use the Service in a way that could cause harm or legal liability.

We may update these terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
